The Company provides access to the Website subject to these Terms and Conditions and Privacy Policy (refer to Privacy Policy Link Located on Website for ZenTrek’s Privacy Policy) which is also applicable to the use of the Website.
Please read both the Terms and Conditions and Privacy Policy carefully; by using the Website you agree to be bound by both of them.  If you do not agree to be bound by these Terms and Conditions and the Privacy Policy, then do not use the Website, or contact The Company’s legal department for other arrangements.

Your submission of information through the Website is governed by The Company’s Privacy Policy, (the “Privacy Policy“) and as applicable theTerms and Conditions, incorporated by reference. 

You represent and warrant that any information you provide in connection with your use of the Website is and shall remain true, accurate, and complete, and that you will maintain and update such information regularly. You agree that if any information you provide that is false, inaccurate, obsolete, infringing of the rights of others, intended to harass or harm, intended to defame and including but not limited to incomplete, is grounds for The Company to terminate your use of the Website and/or any of the Content (as defined below).

In addition, The Company reserves the right to monitor information supplied by those who use the Website, but it is not obliged to do so.  The Company disclaims any responsibility for content submitted by users on or through any area of the Website including, without limitation, any chat areas, forums, comments to news articles, bulletin boards, and e-mail.  ZenTrekscannot and does not seek to limit the opinions and views of our users and such opinions and views, therefore, should not be taken to represent those of ZenTreks.

The Website is a website featuring information and news about The Company, a marketplace for The Company’s products and services, a community center for individuals who purchase The Company’s products or services and an outlet and conduit for communicationthat enables individuals to communicate directly with The Company.

Any infringement can be punishable by law (both criminally and civilly).

While using the Website, you agree to comply with all applicable laws, rules and regulations.  In addition, your use of the Website is conditioned on your compliance with the rules of conduct set out in the section above. You may not use “meta tags” or any other “hidden text” utilizing The Company’s names or Trademarks without our express prior written consent.

Termination

These Terms and Conditions are in effect until terminated or modified.  The Company reserves the right, in its sole discretion to terminate your access to or use of the Website, at any time and for any reason, including if The Company believes that you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions.  Upon any such termination, your right to use the Website will immediately cease.  You agree that any termination of your access to or use of the Website may be effected without prior notice, and that ZenTreks may immediately deactivate or delete your password and user name, and all related information and files associated with it, and/or bar any further access to such information or files.  You agree that ZenTreks shall not be liable to you or any third party for any termination of your access to the Website or to any such information or files, and shall not be required to make such information or files available to you after any such termination.

User Submitted Content

Our Site may have "publicly accessible areas" such as message boards, forums, member profiles, folders or other features that allow users to post Content that will be accessible by the public or the user population generally. ZenTreksis under no obligation to post or use any Content you may provide and The Company may remove your Content at any time in its sole discretion. You agree that ZenTreks is not under any obligation of confidentiality, express or implied, with respect to your Content. You represent and warrant that you own or otherwise control all necessary rights to the Content that you post, that such Content is accurate, that use of the Content you supply does not violate these Terms, specifically including without limitation the requirements of the Rules of Conduct section (below), and will not cause injury to any person or entity, and that you will indemnify ZenTreksfor all claims resulting from the Content you supply.
ZenTreksdoes not generally pre-screen or control Content posted by users of our Website, and, therefore, does not guarantee the accuracy, integrity or quality of such Content. ZenTreksshall have the right (but not the obligation) in its sole discretion to monitor, refuse or remove any Content that is available via our Website for any or no reason, including that any Content violates these Terms or is otherwise objectionable.  The Company takes no responsibility and assume no liability for any Content uploaded, transmitted, or downloaded by you or any third party, or for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, or profanity you may encounter.   • Make available, or redistribute, any of the Content (including using it as part of any library, archive or similar service) without ZenTrek’s express prior written consent.

The Company reserves all rights to co-operate fully with court orders and law enforcement authorities requesting the disclosure of the identity of anyone attempting any of the foregoing.
Registration

Certain services made available on the Website require prior registration to permit their use.  You must provide accurate and complete registration information and inform us of any changes to that information (including your e-mail address) by altering your details as appropriate or by contacting info@zentreks.net.  Individuals are allowed only to register one account, and registration is for use by a single user only.

Children under the age of 13 may not register with us.  If you are between the ages of 13 and 16 you will need to have your parent or guardian’s consent and permission to register.  If found in violation of any registration terms, your account can and may be terminated as explained in the Termination section above.

Where the Website contains links to other websites and resources provided by third parties, these links are provided for your information only and do not represent an endorsement of that website by us.  Because ZenTreks has no control over such sites and resources, you acknowledge and agree that ZenTreks its employees, officers, directors, shareholders, affiliates, agents, representatives, licensors, suppliers and service providers are not responsible for the availability of such external sites or resources, and ZenTreks and its employees, officers, directors, shareholders, affiliates, agents, representatives, licensors, suppliers and service providers neither endorse nor are responsible or liable for any content, advertising, products or other materials on or available through such sites or resources. 

Other websites may provide links to the Website with or without our authorization.  You acknowledge and agree that ZenTreks and its employees, officers, directors, shareholders, affiliates, agents, representatives, licensors, suppliers and service providers do not endorse such sites, and are not and shall not be responsible or liable for any links from those sites to the Website, any content, advertising, products or other materials available on or through such other sites, or any loss or damages incurred in connection therewith.

In addition to these Terms and Conditions, any contests, sweepstakes, surveys, games or similar promotions (collectively, “Promotions“) made available through the Website may be governed by specific rules that are separate from these Terms and Conditions.  By participating in any such Promotion, you will become subject to those rules, which may vary from the terms and conditions set forth herein.  ZenTreks advises you to review carefully any specific rules applicable to a particular Promotion, which will be linked from such Promotion, and to review our Privacy Policy which, in addition to these Terms and Conditions, governs any information you submit in connection with such activities.  To the extent that the terms and conditions of such rules conflict with these Terms and Conditions, the terms and conditions of such rules shall control.

Limitation of Liability

You agree to hold The Company harmless for any death or personal injury or damages you experience caused by our negligence or for our fraudulent misrepresentation or concealment or for any other liability to the extent it can be limited and excluded by applicable laws.

Enforcement of these Terms and Conditions

ZenTreks reserves the right to takes steps that ZenTreks believes are necessary or appropriate to enforce and/or verify compliance with any part of these Terms and Conditions (including, without limitation, The Company’s right to cooperate with any legal process relating to your use of the Website and Contents and/or a third party claim that your use of the Website and Contents is unlawful and/or infringes such third party’s rights).

Choice of Law, Jurisdiction and Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
These Terms and Conditions shall be governed by, and interpreted in accordance with the laws of Nevada, and you irrevocably agree that the courts of Nevada and the Federal Courts of the United States of America shall have non-exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with, these Terms and Conditions although The Company retains the right to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant country.  You agree that any legal action or proceeding between ZenTreks and you for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Nevada.  Neither the course of conduct and/or course of dealing between the parties nor trade practice shall act to modify any provision of this Agreement.  You must file any claim or suit related to our Site within one year after it arises.

You agree that you will resolve any claim, cause of action or dispute (claim) you have with us arising out of or relating to the Website exclusively in a state or federal court located in the State of Nevada. The laws of the State of Nevada will govern your claim, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Nevada for the purpose of litigating all such claims.
